Your information is used to: (1) evaluate your eligibility for an ESA letter evaluation; (2) connect you with a licensed mental health professional for a clinical evaluation; (3) communicate with you about your screening status; and (4) comply with applicable laws and regulations. Health-related information you share is treated as protected health information and handled with the same confidentiality standards required of licensed clinical providers.

3Disclosure of Your Information

We do not sell your personal information. We may share your information with licensed mental health professionals who conduct evaluations, with service providers who assist in operating our platform (under strict confidentiality agreements), or as required by law. We will never disclose your health information to your landlord, housing provider, or any third party without your explicit written consent.

4Health Information & Confidentiality

Information you share about your mental health, treatment history, and disability-related needs is treated as sensitive health information. FHCN is a referral and intake organization — it is not itself a HIPAA covered entity. However, the licensed mental health professionals in our network are independently licensed clinicians who are subject to applicable state licensing laws, professional ethical standards, and, where applicable, HIPAA. The information you share with your evaluating clinician is confidential between you and that clinician. FHCN will not disclose your health information to your landlord, housing provider, or any third party without your explicit written consent.

1Nature of Our Service

FHCN provides an eligibility screening service that connects individuals who may qualify for an Emotional Support Animal (ESA) letter with licensed mental health professionals. We do not guarantee that a screening will result in an ESA letter. The decision to issue an ESA letter rests solely with the evaluating licensed clinician based on their independent professional judgment.

2Clinical Relationship and Scope of Care

FHCN connects individuals with licensed mental health professionals for ongoing clinical care. The ESA letter is the documented outcome of that clinical relationship — not a standalone product. The scope of care, treatment modality, and duration of the clinical relationship are determined by the evaluating licensed clinician in accordance with their professional judgment and applicable state licensing standards. An ESA letter reflects the clinician's professional opinion at the time of issuance and may require renewal as your clinical relationship continues.

3Accuracy of Information

You agree to provide truthful, accurate, and complete information during the screening process. Submitting false or misleading information — including misrepresenting your housing situation, mental health history, or treatment status — is a violation of these Terms and may constitute fraud. FHCN reserves the right to void any letter issued based on fraudulent information.

4Fair Housing Act & Legal Limitations

An ESA letter issued through FHCN is intended to support a reasonable accommodation request under the Fair Housing Act (FHA). FHCN does not provide legal advice. We cannot guarantee that any landlord, housing provider, or HOA will accept an ESA letter, nor can we guarantee any particular legal outcome. For legal advice regarding your housing rights, consult a licensed attorney.

5Acceptable Use

You agree not to use our website or services for any unlawful purpose, to submit false information, to attempt to obtain an ESA letter for an animal that does not provide genuine emotional support, or to interfere with the operation of our platform. Misuse of ESA documentation harms individuals with genuine disabilities and undermines Fair Housing protections for everyone.

6Intellectual Property

All content on this website — including text, graphics, logos, and the FHCN name — is the property of Fair Housing Clinical Network and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

7Limitation of Liability

To the fullest extent permitted by law, FHCN shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services, including any housing dispute outcome. Our total liability for any claim arising from our services shall not exceed the amount you paid for those services.

8Changes to These Terms

We reserve the right to update these Terms of Service and Privacy Policy at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes are posted constitutes your acceptance of the revised terms.

9Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or our services shall be resolved through binding arbitration or in a court of competent jurisdiction in California, and you consent to personal jurisdiction in that forum.
